Section 10(b)

Section 10(b) of the Charter guarantees the right to counsel. Nearly a third of wrongful convictions are caused by false confessions, which often occur when people do not know their 10(b) rights.

The 10 (b) Collective™

Inspired by the Charter, the 10(b) Collective™ is a cause-driven apparel line launched by an award-winning criminal defence lawyer. The aim is to generate conversation about the Charter, empower people to know their rights and reduce the odds of injustice.

Ten percent of all profits from the 10(b) Collective™ will be donated to non-profit organizations which support the expansion of civil liberties and the exoneration of wrongfully convicted persons, many of whom did not know their rights and lost their freedoms.

April 17 is the anniversary date of the Charter. In celebration, 10(b) will be launching with a limited collection of apparel and accessories.

Kaysi Fagan is an award-winning criminal defence lawyer and educator. Formerly based at the headquarters of the International Police (INTERPOL), she is the only practicing criminal defence lawyer in Canada with three law degrees (including two masters) from three different countries. She has devoted the last 13 years to advocating for the expansion of Charter rights. She has appeared in every level of court in the country, including the Supreme Court of Canada, where she successfully argued for the further evolution of the right to counsel (ie. section 10(b) of the Charter).

Beyond the courtroom, Kaysi has been a sessional Instructor at the University of Calgary, Faculty of Law since 2018, teaching ‘Advanced Criminal Law’ to the next generation of lawyers. She is on Faculty with the Law Society of Alberta, and was invited by the RCMP Major Crimes division to speak on the right to counsel (ie. section 10(b)). Kaysi is also a published author, a former legal expert on a true crime television series and a Tedx Speaker. She is one of Canada’s Top 40 Lawyers Under 40 (Lexpert Magazine) and is an Avenue Magazine Top 40 Under 40 alumni.
